1. About Appraise Me

Appraise Me is a vehicle appraisal and offer-facilitation service. We help vehicle owners obtain offers from our internal dealer network by collecting vehicle details, conducting an appraisal, and presenting the vehicle to participating dealers.

Appraise Me is not the buyer of your vehicle unless explicitly stated otherwise in writing. If you accept an offer, the purchase transaction is completed by the buying dealer, who is responsible for pickup, payment, ownership transfer requirements, and the final purchase documentation.

2. Eligibility

By using our services, you represent that:

• you are at least the age of majority in your jurisdiction;
• you have the legal right to provide information about the vehicle;
• you are the owner of the vehicle or are authorized to act on behalf of the owner;
• the information you provide is accurate and complete.

3. No Guarantee of Offer

Submitting your information or booking an appraisal does not guarantee:

• that you will receive an offer;
• that any offer will meet your expectations;
• that any dealer will purchase your vehicle;
• that any appraisal will result in a completed transaction.

All offers are subject to dealer interest, vehicle condition, title status, market conditions, history reports, and any additional verification required by the buying dealer.

4. Vehicle Information and Appraisal Process

By using our services, you authorize us to:

• review the information you provide about your vehicle;
• inspect the vehicle in person at an agreed location;
• photograph the vehicle;
• obtain or review vehicle history information, including CARFAX or similar reports;
• present vehicle details to our internal dealer network for bidding.

You agree to provide truthful, complete, and current information about the vehicle, including but not limited to its condition, mileage, title status, accident history, liens, damage, modifications, and any known issues.

If any material information is inaccurate, incomplete, or omitted, any offer may be revised or withdrawn.

5. No Obligation to Accept an Offer

You are under no obligation to accept any offer presented through Appraise Me.

Unless otherwise expressly agreed in writing, our appraisal service and offer presentation are free to the seller.

6. Dealer Offers

Any offer presented through Appraise Me is made by a third-party dealer, not by Appraise Me, unless expressly stated otherwise.

Dealers may impose conditions before completing a purchase, including additional inspections, title verification, ownership verification, lien clearance, identity verification, or other standard transaction requirements.

Appraise Me is not responsible for changes to an offer caused by:

• inaccurate or incomplete vehicle information;
• undisclosed damage or defects;
• title, lien, registration, or ownership issues;
• market changes;
• dealer-specific underwriting or purchasing decisions.

7. Payment and Pickup

If you accept an offer, the buying dealer is responsible for payment to you and for arranging vehicle pickup. Appraise Me may help coordinate communication and logistics, but Appraise Me does not issue payment to the seller unless expressly stated in writing.

You acknowledge that any certified cheque, transfer, or other payment method is provided by the buying dealer, and the final sale is between you and that dealer.

8. Dealer Network and Limited Role

Appraise Me operates as an intermediary that helps connect sellers with participating dealers in a private network.

We do not guarantee the conduct, timing, performance, or payment practices of any dealer, although we may coordinate the process. To the maximum extent permitted by law, Appraise Me is not liable for disputes arising from the final transaction between seller and dealer, except to the extent caused directly by our own misconduct or as required by law.

9. Seller Responsibilities

You agree that you will:

• provide accurate contact and vehicle information;
• make the vehicle reasonably available for inspection;
• disclose known damage, repairs, liens, branding, and title issues;
• ensure you have authority to sell the vehicle;
• remove personal belongings from the vehicle before pickup;
• provide documents reasonably needed to complete the transaction.

10. Privacy

Your use of our website and services is also governed by our Privacy Policy.

By using our services, you acknowledge that vehicle information may be shared with our private dealer network for bidding purposes, and that limited personal information may be shared with the selected buying dealer if you accept an offer and such disclosure is needed to complete the transaction.

11. Website Use

You agree not to:

• use the website for unlawful purposes;
• submit false, misleading, or fraudulent information;
• interfere with website functionality or security;
• attempt to gain unauthorized access to our systems;
• copy, scrape, reproduce, or exploit website content without permission.

12. Intellectual Property

All website content, branding, logos, graphics, text, and related materials are owned by or licensed to Appraise Me and are protected by applicable intellectual property laws.

You may not use, reproduce, or distribute them without prior written permission.

13. Disclaimer

Our website and services are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, Appraise Me disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

We do not warrant that:

• the website will always be available, secure, or error-free;
• offers will be received within any particular timeframe;
• any dealer will complete a transaction.

14. Limitation of Liability

To the fullest extent permitted by law, Appraise Me and its owners, directors, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, loss of opportunity, loss of data, or loss arising from:

• your use of the website or services;
• your reliance on any offer;
• a dealer's decision to revise, withdraw, or not complete a purchase;
• delays in pickup or payment by a dealer;
• errors in third-party reports or services;
• unauthorized access to or use of information, except where liability cannot be excluded by law.

If Appraise Me is found liable for any claim arising out of these Terms or the services, our total liability will be limited to the greater of:

• the amount you paid us for the service, if any; or
• CAD $100.

Nothing in these Terms limits any rights that cannot legally be waived under applicable law.

15. Indemnity

You agree to indemnify and hold harmless Appraise Me and its affiliates, owners, officers, employees, and contractors from any claims, losses, liabilities, damages, and expenses arising out of:

• information you submit;
• your breach of these Terms;
• your violation of law;
• disputes regarding your authority to sell the vehicle;
• undisclosed liens, damage, title defects, or ownership issues relating to the vehicle.

16. Third-Party Services

Our services may involve third-party providers, including analytics tools, form software, vehicle history providers, and dealers. We are not responsible for third-party systems, services, reports, policies, or conduct.

17. Changes to Services

We may modify, suspend, or discontinue any part of the website or services at any time without notice.

18. Changes to Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised Effective Date. Your continued use of the website or services after changes are posted means you accept the updated Terms.

19. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
